Brazil’s Supreme Court Cancels Deliberations as Inter-Justice Feud Sparks Deep Institutional Crisis

Brazil’s Supreme Court has plunged further into an unprecedented institutional crisis after calling off its formal deliberations for a second straight session. The highly unusual move to halt bench proceedings underscores the severe internal fractures within the nation’s highest judicial body, as escalating controversies threaten to paralyze ordinary court operations.

The disruption comes amid sweeping allegations of official corruption, political bias, and law enforcement interference hovering over multiple members of the bench. The internal discord has mounted so rapidly that it is now spilling directly into the country’s high-stakes national elections scheduled for October.

Chief Justice Luiz Edson Fachin issued the formal order canceling Thursday’s sitting, bringing the tribunal’s standard calendar to an abrupt standstill. In a bid to manage the emergency, Fachin took the rare step of scheduling a makeup session for Tuesday, a day of the week on which the Supreme Court does not normally assemble.

When the full 10-member court convenes for the special Tuesday meeting, the justices will confront an extraordinary agenda item. The panel is set to formally debate and decide whether to open an investigation against one of their own colleagues, Justice Alexandre de Moraes.

The prospective inquiry into de Moraes stems from alleged links to Daniel Vorcaro, the owner of the collapsed financial institution Banco Master. The bank was previously forced to shut down operations in the wake of extensive fraud allegations, making any high-level association between its leadership and the supreme bench a matter of intense legal scrutiny.

The open hostilities currently rocking the high court first broke out on September 1, when Justice André Mendonça unsealed confidential federal police records. The unexpected release of the investigative material brought long-simmering friction inside the tribunal out into public view.

Those unsealed police documents indicated that Vorcaro had repeatedly reached out to de Moraes to seek legal advice. The revelation immediately sparked sharp controversy over judicial propriety and caused the interpersonal relationship between Mendonça and de Moraes to deteriorate into an outright dispute.

The conflict carries significant political and ideological weight because of the two jurists’ histories and high-profile standing. Mendonça, who previously served as solicitor-general under former President Jair Bolsonaro, was appointed to the Supreme Court by the former conservative head of state and remains closely linked to right-wing circles.

By contrast, de Moraes, though regarded as a conservative jurist himself, became an admired figure among supporters of left-wing President Luiz Inácio Lula da Silva. That reputation was cemented last year when de Moraes presided over the landmark case that sentenced Jair Bolsonaro to 27 years in prison for orchestrating an attempted coup.

De Moraes quickly mounted a sharp legal counteroffensive earlier this week. Pushing back against the public disclosures, the justice formally requested that authorities open an inquiry into Mendonça for alleged abuse of power.

De Moraes argued that Mendonça overstepped his judicial boundaries by conducting a private interview with Vorcaro. According to the complaint, Mendonça interrogated the banker without the required presence of either federal police investigators or public prosecutors, violating standard procedural safeguards.

The escalating judicial feud has also triggered immediate chaos inside the country’s top law enforcement apparatus. The power struggle between the magistrates directly spilled over into the leadership hierarchy of Brazil’s Federal Police over the course of the week.

In a rapid sequence of contradictory rulings, competing Supreme Court decisions ordered the removal of the Federal Police director-general, only to have another order reinstate him shortly thereafter. The rapid-fire reversals illustrated the extent to which the bench’s infighting has begun interfering with law enforcement command.

The institutional breakdown arrives at an exceptionally sensitive moment in Brazil’s political calendar, as the country prepares for the looming October presidential vote. Both major political camps have seized upon the high court’s internal war to advance their campaign narratives.

President Lula and his chief election rival, Senator Flávio Bolsonaro—the son of the imprisoned former president—are now demanding separate inquiries into the Supreme Court justices. The calls for accountability have split strictly along established partisan battle lines, further entangling the judicial system in the electoral contest.

With the tribunal caught in the middle of a political storm and police leadership in flux, Tuesday’s unscheduled gathering is expected to serve as a critical test for the Supreme Court. The 10 justices will face the daunting task of resolving the probe into de Moraes while attempting to restore institutional order and credibility before the nation heads to the ballot box.
